British Airways Plc Business Opportunity Grant - November 2009

Terms and Conditions

  1. Promotion Description:

    The “Business Opportunity Grant” Competition (the “Competition”) begins on 23 November 2009 and ends on 16 January 2010 at 11:59 p.m IST. To take part in the Competition Eligible Participants must answer three questions (collectively a “Submission”) on behalf of their Company describing how their Company would benefit from 10 business class flights (to be used within a year) and business support. All three questions must be answered to qualify for the Competition.

  2. Prize:

    The prize consists of the following being awarded to each of the 50 Winning Companies: 10 return business class flights to be used in Club Europe and/or Club World between 1 March 2010 and 28 February 2011 (excluding taxes, fees and charges and surcharges which are payable by the winning Company) (“Prize Flights”); and 5 Regus Businessworld gold memberships.

  3. Eligibility:

    This promotion is only open to Eligible Participants. An Eligible Participant is a person resident in India, aged 18 years or over, who is an employee of an Indian company which employs 250 employees or less, is not part of a subsidiary company and has a valid company registration number and does not have an existing corporate deal with British Airways and who is not an employee, agent or director of British Airways Plc (“BA”) or its subcontractors or travel agents nor anyone connected with this promotion. The Eligible Participant enters this Competition on behalf of his or her Company and must have the power to bind their company to a travel agreement. BA reserves the right to verify the eligibility of Eligible Participants. By taking part in this promotion, Eligible Participants confirm that they accept the terms and conditions set out below.

  4. How to Enter:

    To participate in this Competition, Eligible Participants must register their details and create a login at http://ba.com/india-grants and enter their Submission.

  5. Submission:

    Only one Submission is permitted per Company or per related group of companies. In the event of multiple entries all but the first shall be disregarded. The Submission must include the answer to three questions along with a brief description of what your Company does, in English and in text format (Submissions generated by script, macro or other automated means are void). Please see ‘Judging’ section for the questions and judging criteria. The Submission must be the Eligible Participant’s original, previously unpublished work and not contain any third party copyrighted material. The Eligible Participant is responsible for gaining all appropriate clearances, permissions and releases for the Submission, including releases from all persons described in the Submission, if requested (in the event an Eligible Participant cannot provide all required releases, BA reserves the right, in its sole discretion, to disqualify the applicable Submission). Any Submission that is considered by BA in its sole and absolute discretion to be obscene, libellous, hateful or otherwise objectionable, in whole or in part, will be disqualified and removed from the Competition. Submissions received from any Eligible Participant in excess of the stated word limit will be void. Submissions become the exclusive property of BA and will not be returned or acknowledged. Proof of submission is not considered proof of delivery to or receipt of such entry. In the event of a dispute as to any Submission, the authorised account holder (the natural person assigned to the email address by an Internet access provider or other organisation responsible for assigning email addresses), of the email address used to register for the Competition will be deemed to be the Eligible Participant. In the event a dispute regarding the identity of the individual who actually submitted the Submission cannot be resolved to BA’s satisfaction, the affected Submission will be deemed ineligible.

  6. Judging:

    An independent panel of judges selected by BA, in its sole discretion, will select fifty (50) potential winners from among all eligible Submissions based on the following criteria (“Judging Criteria”):

    1. Question # 1 – Tell us about your Company's specific goals and objectives for 2010 – (20%) (Answer’s specificity of goals and objectives for 2010);
    2. Question # 2 – How would the opportunity and continuity of business travel for a year support/benefit your Company? – (40%) (Answer’s description of contribution to business goals and objectives and how Question #2 ties into Question #1, clear vision of what the Prize will allow the Company to accomplish that it otherwise could not accomplish);
    3. Question # 3 – What specific business objective could travel and face-to-face meetings help your Company achieve that remote communication (i.e., phone or video conference) could not? (30%) (Whether or not the answer calls out specific, measurable and key business objectives, demonstrates the benefit of a face to face meeting approach versus other methods, confidence in achieving result, clear examples);
    4. Overall articulation and style of all three (3) answers to questions (10%).
    5. The Winning Companies will be the Eligible Participants who, in the opinion of the judges answer the above in the most apt and original way.

    In the event of a tie between two or more companies providing more than 50 eligible possible winners, alternative judges from the panel will be selected to remark the lower scoring winners to determine no more than 50 winners. BA reserves the right to select fewer than the stated number of potential winners and award fewer than the stated number of prizes, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.

    Judges' decisions are final and binding and not subject to review or appeal.

  7. Winning Company Requirements:

    BA will email or telephone the Eligible Participants of the Winning Companies before 19 February 2010. The Eligible Participant of the winning Company must confirm his/her acceptance of the prize by email before 26 February 2010 and the Company must enrol into BA’s “On Business” programme (if not already a member) providing ALL of the information required and must meet the requirements of “On Business” Terms and Conditions. If companies are already a member of the On Business Programme, this information may be used to contact them and not the information given in the entry form. If the On Business number is incorrect, we will not be able to contact winners. Any delay in receiving all of the information required for enrolment, will result in an automatic email requesting the required information and possible delays/forfeit of the prize. If the winning Company does not confirm his/her prize by this date and the Company is not successfully enrolled in to BA’s “On Business” programme, a supplementary winner may be chosen at BA’s discretion. BA accepts no responsibility for damage or loss resulting from misdirected or incomplete entries arising from computer malfunction, viruses, bugs or telephone malfunction or other such causes. BA are in no way liable for the reproduction or indirect access via third party web site or home page access which reproduction misstates or omits any of the information or terms and conditions connected with the promotion.

  8. List of Winning Companies:

    Case studies on winning Submissions may be written and used in publications or websites including but not limited to Ba.com.

  9. Media:

    By participating in this Competition, the Eligible Participant agrees to the personal data they supply being used by BA (or its agents or contractors) to administer this promotion. BA may also use this information to contact the Eligible Participant to discuss future business travel plans and its products and services, which may include contact by email, post or telephone. All Eligible Participants may be contacted by British Airways , to confirm agreement to publish stories about their Submission. British Airways may also contact the Winning Companies to publish stories about how they have used their grant/success achieved from being able to carry out meetings face-to-face. BA shall have no obligation (express or implied) to use any Submission, and BA may at any time abandon the use of any Submission for any reason, with or without legal justification or excuse and entrants will not be entitled to damages or any kind of compensation.

  10. Prize Flights:

    Winning Companies are responsible for paying taxes, fees and charges associated with Prize Flights. All Prize Flights are from any of the 5 cities - Delhi, Mumbai, Bengaluru, Hyderabad and Chenni to London Heathrow and beyond to destinations to which BA flies at the time of such Prize Flight. Each Prize ticket is for one passenger. Prize Flights must be booked at least 21 days prior to departure. Prize Flights are subject to availability and capacity control and may be unavailable at peak periods/certain dates. BA reserves the right to limit the number of prize travel seats made available on any flight, and it is possible that seats allocated to the winners’ fare class on a particular flight may be fully booked even though seats are still available for sale at a different fare or booking class in the same cabin. BA does not accept any responsibility in the event that Winning Companies are unable to book their preferred flight(s). Prize Flights are on mainline scheduled services operated and marketed by BA with a BA prefix number. Travel on BA franchise, Cityflyer, codeshare and alliance airlines is not allowed. All incidental expenses and any additional travel costs are the responsibility of the Winning Companies. The Winning Companies are also responsible for any visas, insurance and inoculations that may be required. Where available, all Prize Flight tickets will be issued as e-tickets. Prize Flights are non refundable, non changeable and non transferable. Once booked, no changes can be made to tickets. No cash or credit alternative prizes are offered. No upgrades are allowed. All travel on BA Prize Flights is subject to BA’s general conditions of carriage for passengers and baggage (see ba.com) and the notice and conditions of contract contained on each ticket or itinerary. Prize Flights cannot be used in conjunction with any BA Miles programme, On Business programme or any other discount, discount coupon(s) or voucher(s), promotion(s) or special offer(s) by BA or jointly with any other organisation, bonus, awards, or certificates. BA reserves the right to provide substitute prizes of similar value should the specified Prize Flights become unavailable for reasons beyond its control. BA reserves the right to withdraw Prize Flights if it is believed they are not being used appropriately. Only those flying for business purposes for the company that has been awarded the flights are eligible to use the flights. BA is only responsible for providing Prize Flights.

  11. Promoter:

Promotional materials form part of these Terms and Conditions. This promotion is governed by Indian law and is subject to the jurisdiction of the Indian courts. The names of the winners may be obtained by emailing india.grants@ba.com. BA reserves the right to cancel or amend without notice the terms of this Competition in the event of major catastrophe, war, civil or military disturbance, earthquakes or any actual anticipated or alleged breach of any applicable law or regulation or any other circumstances beyond the reasonable control of BA. BA accepts no responsibility should any partner not fulfil their stated prize.

  12. Partner Terms and Conditions:

    All Winning Companies are only eligible for partner prizes if they satisfy the terms and conditions of partner requirements. Responsibility for fulfilment of partner prizes lies with that of the relevant partner. Partners may change without notice.
